{"data":{"id":"us-wa/rcw-11.98.105","jurisdiction":"us-wa","citation":"RCW 11.98.105","heading":"Nonliability of third persons without knowledge of breach.","body":"(1) A person other than a beneficiary who in good faith assists a trustee, or who in good faith and for value deals with a trustee, without knowledge that the trustee is exceeding or improperly exercising the trustee's powers is protected from liability as if the trustee properly exercised the power.\n(2) A person other than a beneficiary who in good faith deals with a trustee is not required to inquire into the extent of the trustee's powers or the propriety of their exercise.\n(3) A person who in good faith delivers assets to a trustee need not ensure their proper application.\n(4) A person other than a beneficiary who in good faith assists a former trustee, or who in good faith and for value deals with a former trustee, without knowledge that the trusteeship has terminated is protected from liability as if the former trustee were still a trustee.\n(5) Comparable protective provisions of other laws relating to commercial transactions or transfer of securities by fiduciaries prevail over the protection provided by this section.","path":["Title 11","Chapter 11.98"],"source_url":"https://app.leg.wa.gov/rcw/default.aspx?cite=11.98.105","current_through":"July 15, 2026","vintage":"","retrieved_at":"2026-09-06T00:59:52Z","sha256":"3b848765e70d50599daa559dcb549de6707ab5cd75facb69bb82c80124b3d496","source_id":"us-wa","stale":false,"prev":"us-wa/rcw-11.98.100","next":"us-wa/rcw-11.98.107"},"notice":"GroundRules: Original legal text.
