{"data":{"id":"us-wa/rcw-38.42.070","jurisdiction":"us-wa","citation":"RCW 38.42.070","heading":"Fines and penalties under contracts.","body":"(1) If an action for compliance with the terms of a contract is stayed pursuant to this chapter, a penalty shall not accrue for failure to comply with the terms of the contract during the period of the stay.\n(2) If a service member or his or her dependent fails to perform an obligation arising under a contract and a penalty is incurred arising from that nonperformance, a court may reduce or waive the fine or penalty if:\n(a)(i) The service member was in military service at the time the fine or penalty was incurred; or\n(ii) The action is against a dependent of the service member and the service member was in military service at the time the fine or penalty was incurred; and\n(b) The ability of the service member or dependent to perform the obligation was materially affected by the military service.","path":["Title 38","Chapter 38.42"],"source_url":"https://app.leg.wa.gov/rcw/default.aspx?cite=38.42.070","current_through":"July 15, 2026","vintage":"","retrieved_at":"2026-09-06T02:36:43Z","sha256":"b3e8088c2129b09d0140759e70ebcb41ab37b3cd11b32b8d15a9569baf6fa4a2","source_id":"us-wa","stale":false,"prev":"us-wa/rcw-38.42.060","next":"us-wa/rcw-38.42.080"},"notice":"GroundRules: Original legal text.
