{"data":{"id":"us-wa/rcw-4.24.005","jurisdiction":"us-wa","citation":"RCW 4.24.005","heading":"Tort actions—Attorneys' fees—Determination of reasonableness.","body":"Any party charged with the payment of attorney's fees in any tort action may petition the court not later than forty-five days of receipt of a final billing or accounting for a determination of the reasonableness of that party's attorneys' fees. The court shall make such a determination and shall take into consideration the following:\n(1) The time and labor required, the novelty and difficulty of the questions involved, and the skill requisite to perform the legal service properly;\n(2) The likelihood, if apparent to the client, that the acceptance of the particular employment will preclude other employment by the lawyer;\n(3) The fee customarily charged in the locality for similar legal services;\n(4) The amount involved and the results obtained;\n(5) The time limitations imposed by the client or by the circumstances;\n(6) The nature and length of the professional relationship with the client;\n(7) The experience, reputation, and ability of the lawyer or lawyers performing the services;\n(8) Whether the fee is fixed or contingent;\n(9) Whether the fixed or contingent fee agreement was in writing and whether the client was aware of his or her right to petition the court under this section;\n(10) The terms of the fee agreement.","path":["Title 4","Chapter 4.24"],"source_url":"https://app.leg.wa.gov/rcw/default.aspx?cite=4.24.005","current_through":"July 15, 2026","vintage":"","retrieved_at":"2026-09-06T00:29:43Z","sha256":"474fe712f452346d0cbe9552807d551cf246391d2ea1f32f6ed34f9af47dc6a7","source_id":"us-wa","stale":false,"prev":"us-wa/rcw-4.22.925","next":"us-wa/rcw-4.24.010"},"notice":"GroundRules: Original legal text.
