{"data":{"id":"us-wa/rcw-41.05.042","jurisdiction":"us-wa","citation":"RCW 41.05.042","heading":"Health information—Processes, guidelines, and standards.","body":"By December 1, 2011, the lead organization shall, consistent with the federal health insurance portability and accountability act, develop processes, guidelines, and standards that address:\n(1) Identification and prioritization of high value health data from health data providers. High value health data include:\n(a) Prescriptions;\n(b) Immunization records;\n(c) Laboratory results;\n(d) Allergies; and\n(e) Diagnostic imaging;\n(2) Processes to request, submit, and receive data;\n(3) Data security, including:\n(a) Storage, access, encryption, and password protection;\n(b) Secure methods for accepting and responding to requests for data;\n(c) Handling unauthorized access to or disclosure of individually identifiable patient health information, including penalties for unauthorized disclosure; and\n(d) Authentication of individuals, including patients and providers, when requesting access to health information, and maintenance of a permanent audit trail of such requests, including:\n(i) Identification of the party making the request;\n(ii) The data elements reported; and\n(iii) Transaction dates;\n(4) Materials written in plain language that explain the exchange of health information and how patients can effectively manage such information, including the use of online tools for that purpose;\n(5) Materials for health care providers that explain the exchange of health information and the secure management of such information.","path":["Title 41","Chapter 41.05"],"source_url":"https://app.leg.wa.gov/rcw/default.aspx?cite=41.05.042","current_through":"July 15, 2026","vintage":"","retrieved_at":"2026-09-06T02:42:22Z","sha256":"5603e42d42ec3d102a1c9637a78c089a39af8abeae7e03c44945c0172f4aee3a","source_id":"us-wa","stale":false,"prev":"us-wa/rcw-41.05.039","next":"us-wa/rcw-41.05.046"},"notice":"GroundRules: Original legal text.
