{"data":{"id":"us-wa/rcw-43.05.090","jurisdiction":"us-wa","citation":"RCW 43.05.090","heading":"Department of labor and industries—Consultative visit, report—Compliance inspection, citation.","body":"(1) Following a consultative visit pursuant to RCW 49.17.250, the department of labor and industries shall issue a report to the employer that the employer shall make available to its employees. The report shall contain:\n(a) A description of the condition that is not in compliance and the text of the specific section or subsection of the applicable state or federal law or rule;\n(b) A statement of what is required to achieve compliance;\n(c) The date by which the department requires compliance to be achieved;\n(d) Notice of means to contact technical assistance services provided by the department; and\n(e) Notice of when, where, and to whom a request to extend the time to achieve compliance for good cause may be filed with the department.\n(2) Following a compliance inspection pursuant to RCW 49.17.120, the department of labor and industries shall issue a citation for violations of industrial safety and health standards. The citation shall not assess a penalty if the violations:\n(a) Are determined not to be of a serious nature;\n(b) Have not been previously cited;\n(c) Are not willful; and\n(d) Do not have a mandatory penalty under chapter 49.17 RCW.","path":["Title 43","Chapter 43.05"],"source_url":"https://app.leg.wa.gov/rcw/default.aspx?cite=43.05.090","current_through":"July 15, 2026","vintage":"","retrieved_at":"2026-09-06T02:46:19Z","sha256":"ec967a4ecaebff06853f473b5e97d9995314bf8cb9c01574d306c1240c8efe07","source_id":"us-wa","stale":false,"prev":"us-wa/rcw-43.05.080","next":"us-wa/rcw-43.05.100"},"notice":"GroundRules: Original legal text.
