Stat. § 244.16","heading":"Judicial relief.","body":"(1) The following persons may petition the circuit court of the county where the principal is present or of the county of the principal’s legal residence to construe a power of attorney or review the agent’s conduct, and grant appropriate relief:\n(a) The principal or the agent.\n(b) A guardian, conservator, or other fiduciary acting for the principal.\n(c) A person authorized to make health-care decisions for the principal.\n(d) The principal’s spouse, parent, or descendant.\n(e) The principal’s domestic partner.\n(f) An individual who would qualify as a presumptive heir of the principal.\n(g) A person named as a beneficiary to receive any property, benefit, or contractual right on the principal’s death or as a beneficiary of a trust created by or for the principal that has a financial interest in the principal’s estate.\n(h) A governmental agency having regulatory authority to protect the welfare of the principal.\n(i) The principal’s caregiver or another person that demonstrates sufficient interest in the principal’s welfare.\n(j) A person asked to accept the power of attorney.\n(2) Upon motion by the principal, the court shall dismiss a petition filed under this section, unless the court finds that the principal lacks capacity to revoke the agent’s authority or the power of attorney.","path":["Chs. 240-244, Fraudulent Conveyances and Contracts","Chapter 244 Uniform Power Of Attorney For Finances And Property","SUBCHAPTER I GENERAL PROVISIONS"],"source_url":"https://docs.legis.wisconsin.gov/document/statutes/244.16","current_through":"2023-24 Wisconsin Statutes updated through 2025 Wis.
