Stat. § 822.45","heading":"Role of prosecutor.","body":"(1) A prosecutor, in a case arising under this chapter or involving the Hague Convention on the Civil Aspects of International Child Abduction, may take any lawful action, including resort to a proceeding under this subchapter or any other available civil proceeding to locate a child, obtain the return of a child, or enforce a child custody determination if any of the following exists:\n(a) A child custody determination.\n(b) A request to do so from a court in a pending child custody proceeding.\n(c) A reasonable belief that a criminal statute has been violated.\n(d) A reasonable belief that the child has been wrongfully removed or retained in violation of the Hague Convention on the Civil Aspects of International Child Abduction.\n(2) A prosecutor acting under this section acts on behalf of the court and may not represent any party.","path":["Chs. 801-847, Civil Procedure","Chapter 822 Uniform Child Custody Jurisdiction And Enforcement Act","SUBCHAPTER III ENFORCEMENT"],"source_url":"https://docs.legis.wisconsin.gov/document/statutes/822.45","current_through":"2023-24 Wisconsin Statutes updated through 2025 Wis.
