Stat. § 853.13","heading":"Contracts.","body":"(1) A contract to make a will or devise, not to revoke a will or devise or to die intestate may be established only by any of the following:\n(a) Provisions of a will stating the material provisions of the contract.\n(b) An express reference in a will to a contract and extrinsic evidence proving the terms of the contract.\n(c) A valid written contract, including a marital property agreement under s. 766.58 (3) (e).\n(d) Clear and convincing extrinsic evidence.\n(2) The execution of a joint will or mutual wills does not create a presumption of a contract not to revoke the will or wills.","path":["Chs. 851-882, Probate","Chapter 853 Wills","SUBCHAPTER I GENERAL RULES"],"source_url":"https://docs.legis.wisconsin.gov/document/statutes/853.13","current_through":"2023-24 Wisconsin Statutes updated through 2025 Wis.
