Stat. § 1-26-713","heading":"Loss of goodwill.","body":"(a) In addition to fair market value determined under W.S. 1-26-704, the owner of a business conducted on the property taken, or on the remainder if there is a partial taking, shall be compensated for loss of goodwill only if the owner proves that the loss:\n(i) Is caused by the taking of the property or the injury to the remainder;\n(ii) Cannot reasonably be prevented by a relocation of the business or by taking steps and adopting procedures that a reasonably prudent person would take and adopt in preserving the goodwill;\n(iii) Will not be included in relocation payments under W.S. 16-7-101 through 16-7-121; and\n(iv) Will not be duplicated in the compensation awarded to the owner.\n(b) Within the meaning of this section, \"goodwill\" consists of the benefits that accrue to a business as a result of its location, reputation for dependability, skill or quality and any other circumstances resulting in probable retention of old or acquisition of new patronage.","path":["TITLE 1 - CODE OF CIVIL PROCEDURE","CHAPTER 26 - EMINENT DOMAIN","ARTICLE 7 - COMPENSATIO"],"source_url":"https://wyoleg.gov/statutes/compress/title01.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:31Z","sha256":"60a8575919081dd32d64a763c1d1f06f03720d0ba3211a372d0a6177a3a216b7","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-1-26-712","next":"us-wy/wyo.-stat.-1-26-714"},"notice":"GroundRules: Original legal text.
