Stat. § 3-9-215","heading":"Retirement plans.","body":"(a) Unless the power of attorney otherwise provides, language in a power of attorney granting general authority with respect to retirement plans authorizes the agent to:\n(i) Select the form and timing of payments under a retirement plan and withdraw benefits from a plan;\n(ii) Make a rollover including a direct trustee-to-trustee rollover of benefits from one (1) retirement plan to another;\n(iii) Establish a retirement plan in the principal's name;\n(iv) Make contributions to a retirement plan;\n(v) Exercise investment powers available under a retirement plan;\n(vi) Borrow from, sell assets to or purchase assets from a retirement plan.\n(b) As used in this section, \"retirement plan\" means a plan or account created by an employer, the principal or another person to provide retirement benefits or deferred compensation of which the principal is a participant, beneficiary or owner, including a plan or account under the following sections of the Internal Revenue Code:\n(i) An individual retirement account under 26 U.S.C. section 408;\n(ii) A Roth individual retirement account under 26 U.S.C. section 408A;\n(iii) A deemed individual retirement account under 26 U.S.C. section 408(q);\n(iv) An annuity or mutual fund custodial account under 26 U.S.C. section 403(b);\n(v) A pension, profit sharing, stock bonus or other retirement plan qualified under 26 U.S.C. section 401(a);\n(vi) A deferred compensation plan under 26 U.S.C. section 457(b);\n(vii) A nonqualified deferred compensation plan under 26 U.S.C. section 409A.","path":["TITLE 3 - GUARDIAN AND WARD","CHAPTER 9 - UNIFORM POWER OF ATTORNEY ACT","ARTICLE 2 - AUTHORITY"],"source_url":"https://wyoleg.gov/statutes/compress/title03.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:31Z","sha256":"c355428b88b74c52761ace8194589fb616dcf28ff4fb0f6483be64da8852a085","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-3-9-214","next":"us-wy/wyo.-stat.-3-9-216"},"notice":"GroundRules: Original legal text.
