Stat. § 34-29-102","heading":"Classification of digital assets as property; applicability to Uniform Commercial Code; application of other law.","body":"(a) Digital assets are classified in the following manner:\n(i) Digital consumer assets are intangible personal property and shall be considered general intangibles, as defined in W.S. 34.1-9-102(a)(xlii), only for the purposes of article 9 of the Uniform Commercial Code, title 34.1, Wyoming statutes;\n(ii) Digital securities are intangible personal property and shall be considered securities, as defined in W.S. 34.1-8-102(a)(xv), and investment property, as defined in W.S. 34.1-9-102(a)(xlix), only for the purposes of articles 8 and 9 of the Uniform Commercial Code, title 34.1, Wyoming statutes;\n(iii) Virtual currency is intangible personal property and shall be considered money, notwithstanding W.S. 34.1-1-201(b)(xxiv), only for the purposes of article 9 of the Uniform Commercial Code, title 34.1, Wyoming statutes.\n(b) Consistent with W.S. 34.1-8-102(a)(ix), a digital asset may be treated as a financial asset under that paragraph, pursuant to an agreement with the owner of the digital asset. If treated as a financial asset, the digital asset shall remain intangible personal property.\n(c) A bank providing custodial services under W.S. 34-29-104 shall be considered to meet the requirements of W.S. 34.1-8-102(a)(xiv).\n(d) Classification of digital assets under this section shall be construed in a manner to give the greatest effect to this chapter, but shall not be construed to apply to any other asset.\n(e) This chapter shall be considered a consumer protection statute for the purposes of W.S. 34.1-9-201(b).","path":["TITLE 34 - PROPERTY, CONVEYANCES AND SECURITY TRANSACTIONS","CHAPTER 29 - DIGITAL ASSETS","ARTICLE 1 - IN GENERAL"],"source_url":"https://wyoleg.gov/statutes/compress/title34.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:32Z","sha256":"d3cc7df33815031f88e704babc92413be37523d6e3e01d4eb02a79ec25aaa3c3","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-34-29-101","next":"us-wy/wyo.-stat.-34-29-103"},"notice":"GroundRules: Original legal text.
