Stat. § 35-11-1802","heading":"Immunity for innocent owners.","body":"(a) An innocent owner is not liable for investigation, monitoring, remediation or other response action regarding contamination attributable to a release, discharge or migration of contaminants on his property.\n(b) To be eligible for immunity under this act, a person shall:\n(i) Grant to the department or to a person designated by the department, reasonable access to the land for purposes of investigation, monitoring or remediation;\n(ii) Comply with any requirements established by the department that are necessary to maintain state authorization to implement federal regulatory programs;\n(iii) Not use the real property in a manner that causes exposure of the public to harmful environmental conditions; and\n(iv) Comply with any engineering or institutional controls applicable to the real property.","path":["TITLE 35 - PUBLIC HEALTH AND SAFETY","CHAPTER 11 - ENVIRONMENTAL QUALITY","ARTICLE 18 - INNOCENT OWNERS"],"source_url":"https://wyoleg.gov/statutes/compress/title35.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:32Z","sha256":"de4d3a891efb749e7cdfb921e8039522cb3c09afdb98ec3cf05689ef6c03c2b6","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-35-11-1801","next":"us-wy/wyo.-stat.-35-11-1803"},"notice":"GroundRules: Original legal text.
