Stat. § 40-1-205","heading":"Exceptions.","body":"(a) The provisions of this article shall not apply to:\n(i) A person that owns or has the right to license or enforce a patent if the person is:\n(A) Notifying another of the ownership right or enforcement right in the patent;\n(B) Notifying another that the patent is available for license or sale;\n(C) Notifying another of the infringement of the patent pursuant to title 35 of the United States Code or section 262 of title 42 of the United States Code; or\n(D) Seeking compensation from another person for a past or present infringement of a patent, or for a license, if it is reasonable to believe that the person owes the compensation.\n(ii) A demand letter sent by:\n(A) An owner of the patent that is using the patent in connection with substantial research, commercial development, production, manufacturing, processing or delivery of products or materials; or\n(B) Any institution of higher education or any technology transfer organization whose primary purpose is to facilitate the commercialization of technology developed by an institution of higher education.","path":["TITLE 40 - TRADE AND COMMERCE","CHAPTER 1 - TRADEMARKS AND SERVICE MARKS","ARTICLE 2 - BAD FAITH ASSERTION OF PATENT INFRINGEMENT"],"source_url":"https://wyoleg.gov/statutes/compress/title40.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:32Z","sha256":"32058877edbad37ce767eeb98b45ea731cf14bf41e77ed9e510f72bb50a398a2","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-40-1-204","next":"us-wy/wyo.-stat.-40-2-101"},"notice":"GroundRules: Original legal text.
