Stat. § 40-12-402","heading":"Sending unpermitted or misleading electronic mail prohibited.","body":"(a) No person may initiate the transmission, conspire with another to initiate the transmission or assist the transmission of a commercial electronic mail message from a computer located in Wyoming or to an electronic mail address that the sender knows or has reason to know is held by a Wyoming resident, or to an address that the sender knows or has reason to know is located in a state or other jurisdiction with laws similar to this state's laws regarding commercial electronic mail, that:\n(i) Uses a third party's internet domain name without permission of the third party, or otherwise misrepresents or obscures any information in identifying the point of origin or the transmission path of a commercial electronic mail message; or\n(ii) Contains false or misleading information in the subject line.\n(b) For purposes of this section, a person knows that the intended recipient of a commercial electronic mail message is a Wyoming resident if that information is available, upon request, from the registrant of the internet domain name contained in the recipient's electronic mail address.\n(c) For purposes of this article, a service provider does not assist in the transmission of a commercial electronic mail message in violation of this article if:\n(i) The activity which violates this article was not directed by the service provider or its agent;\n(ii) The service provider does not receive a financial benefit directly attributable to the violation of this article by one (1) of its customers; and\n(iii) The service provider does not provide the equipment or complete management of systems found to have an open mail relay.","path":["TITLE 40 - TRADE AND COMMERCE","CHAPTER 12 - CONSUMER PROTECTION","ARTICLE 4 - COMMERCIAL ELECTRONIC MAIL"],"source_url":"https://wyoleg.gov/statutes/compress/title40.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:32Z","sha256":"4f8efc3d4858e1dc08fa89b17edcbff81ea206e8714a1e5fd960f321fd97e277","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-40-12-401","next":"us-wy/wyo.-stat.-40-12-403"},"notice":"GroundRules: Original legal text.
