Stat. § 6-3-302","heading":"Criminal entry; penalties; affirmative defenses.","body":"(a) A person is guilty of criminal entry if, without authority, he knowingly enters a building, occupied structure, vehicle or cargo portion of a truck or trailer, or a separately secured or occupied portion of those enclosures.\n(b) It is an affirmative defense to prosecution under this section that:\n(i) The entry was made because of a mistake of fact or to preserve life or property in an emergency;\n(ii) The enclosure was abandoned;\n(iii) The enclosure was at the time open to the public and the person complied with all lawful conditions imposed on access to or remaining in the enclosure; or\n(iv) The person reasonably believed that the owner of the enclosure, or other person empowered to license access to the enclosure, would have authorized him to enter.\n(c) Criminal entry is a misdemeanor punishable by imprisonment for not more than six (6) months, a fine of not more than seven hundred fifty dollars ($750.00), or both.","path":["TITLE 6 - CRIMES AND OFFENSES","CHAPTER 3 - OFFENSES AGAINST PROPERTY","ARTICLE 3 - BURGLARY AND CRIMINAL INTRUSION"],"source_url":"https://wyoleg.gov/statutes/compress/title06.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:32Z","sha256":"16812004a8a0404c9e4d6e16381625a0d63cd05b678eb0206cee25cb7bbd4fa0","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-6-3-301","next":"us-wy/wyo.-stat.-6-3-303"},"notice":"GroundRules: Original legal text.
