Stat. § 7-12-306","heading":"Designation of testing laboratory.","body":"(a) If the court orders DNA testing pursuant to W.S. 7-12-305(e), the DNA test shall be performed by the Wyoming state crime laboratory unless the movant establishes that the state crime laboratory has a conflict of interest or does not have the capability to perform the necessary testing.\n(b) If the court orders that the DNA testing under W.S. 7-12-305(e) shall be conducted by a laboratory other than the state crime laboratory, the court shall require that the testing be performed:\n(i) Under reasonable conditions designed to protect the state's interests in the integrity of the evidence;\n(ii) By a laboratory that:\n(A) Meets standards that at minimum comply with the standards of the DNA advisory board established pursuant to 42 U.S.C. 14131; and\n(B) Is accredited by the American society of crime laboratory directors accreditation board.","path":["TITLE 7 - CRIMINAL PROCEDURE","CHAPTER 12 - APPEAL, EXCEPTIONS AND NEW TRIAL","ARTICLE 3 - NEW TRIAL"],"source_url":"https://wyoleg.gov/statutes/compress/title07.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:32Z","sha256":"ac06e346af86c61a0205f8e7a65e17a0bebb1fc78dd3ed1a6dc21a24824c9423","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-7-12-305","next":"us-wy/wyo.-stat.-7-12-307"},"notice":"GroundRules: Original legal text.
