Stat. § 9-5-302","heading":"Definitions.","body":"(a) As used in this act:\n(i) \"Constitutional implications\" means the unconstitutional taking of private property as determined by the attorney general in light of current case law;\n(ii) \"Government agency\" means the state of Wyoming and any officer, agency, board, commission, department or similar body of the executive branch of state government;\n(iii) \"Governmental action\" or \"action\":\n(A) Means:\n(I) Proposed rules by a state agency that if adopted and enforced may limit the use of private property;\n(II) Required dedications or exactions from owners of private property by a state agency.\n(B) Does not include:\n(I) Activity in which the power of eminent domain is exercised formally;\n(II) Repealing rules discontinuing governmental programs or amending rules in a manner that lessens interference with the use of private property;\n(III) Law enforcement activity involving seizure or forfeiture of private property for violations of law or as evidence in criminal proceedings;\n(IV) Orders that are authorized by statute, that are issued by a state agency or a court of law and that were the result of a violation of state law;\n(V) Actions necessary to maintain or protect public health and safety.\n(iv) \"Private property\" means property protected by amendments V and XIV of the constitution of the United States or article 1, section 33 of the constitution of the state of Wyoming;\n(v) \"Taking\" means an uncompensated taking of private property in violation of the state or federal constitution;\n(vi) \"This act\" means W.S. 9-5-301 through 9-5-305.","path":["TITLE 9 - ADMINISTRATION OF THE GOVERNMEN","CHAPTER 5 - PROPERTY AND BUILDING","ARTICLE 3 REGULATORY TAKINGS"],"source_url":"https://wyoleg.gov/statutes/compress/title09.pdf","current_through":"2026 Budget Session; as of 2026-07-01","vintage":"","retrieved_at":"2026-09-04T00:16:32Z","sha256":"c17574d04cee72fcb0823453ba6e8ae4332f026ba1d12e26422cb932806bdbbf","source_id":"us-wy","stale":false,"prev":"us-wy/wyo.-stat.-9-5-301","next":"us-wy/wyo.-stat.-9-5-303"},"notice":"GroundRules: Original legal text.
