{"data":{"id":"us/10-cfr-609.3","jurisdiction":"us","citation":"10 CFR 609.3","heading":"Title XVII eligible projects.","body":"(a)(1) DOE is authorized to provide loan Guarantees for certain categories of projects under Title XVII including:\n(i) Innovative Energy Projects under section 1703 of Title XVII;\n(ii) Innovative Supply Chain Projects under section 1703 of Title XVII;\n(iii) State Energy Financing Institution Projects under section 1703 of Title XVII; and\n(iv) Energy Dominance Financing Projects under section 1706 of Title XVII.\n(2) A Project meeting the applicable eligibility requirements set forth herein constitutes an “Eligible Project” under Title XVII.\n(b) An eligible Innovative Energy Project is a project that:\n(1) Falls within a category set forth in section 1703(b) of Title XVII;\n(2) Is located in the United States;\n(3) Is at one location, except that the project may be located at two or more locations if the project is comprised of installations or facilities employing a single New or Significantly Improved Technology that is deployed pursuant to an integrated and comprehensive business plan. An Innovative Energy Project located in more than one location is a single Eligible Project;\n(4) Deploys a New or Significantly Improved Technology; and\n(5) Avoids, reduces, utilizes, or sequesters air pollutants or anthropogenic emissions of greenhouse gases.\n(c) An eligible Innovative Supply Chain Project is a project that:\n(1) Manufactures a product with an end-use set forth in section 1703(b) of Title XVII;\n(2) Is located in the United States;\n(3) Is at one location, except that the project may be located at two or more locations if the project is comprised of installations or facilities employing a single New or Significantly Improved Technology that is deployed pursuant to an integrated and comprehensive business plan. An Innovative Supply Chain Project located in more than one location is a single Eligible Project;\n(4) Either:\n(i) Deploys a New or Significantly Improved Technology in the manufacturing process; or\n(ii) Manufactures a product that represents a New or Significantly Improved Technology; and\n(5) Avoids, reduces, utilizes, or sequesters air pollutants or anthropogenic emissions of greenhouse gases through:\n(i) The relevant manufacturing process of the relevant product; or\n(ii) The end-use of the component on a full life-cycle basis.\n(d) An eligible State Energy Financing Institution Project is a project that:\n(1) Falls within a category set forth in section 1703(b) of Title XVII;\n(2) Is located at one or more locations in the United States;\n(3) Avoids, reduces, utilizes, or sequesters air pollutants or anthropogenic emissions of greenhouse gases;\n(4) Receives financial support or credit enhancements from a State Energy Financing Institution; and\n(5) May include a partnership between one or more State Energy Financing Institutions and private entities, Tribal entities, or Alaska Native corporations in carrying out the project.\n(e) An eligible Energy Dominance Financing Project is a project that:\n(1) Is located in the United States;\n(2) Either:\n(i) Retools, repowers, repurposes, or replaces Energy Infrastructure that has ceased operations;\n(ii) Enables operating Energy Infrastructure to increase capacity or output; or\n(iii) Supports or enables the provision of known or forecastable electric supply at time intervals necessary to maintain or enhance grid reliability or other system adequacy needs; and\n(3) May include the remediation of environmental damage associated with Energy Infrastructure.","path":["Title 10—Energy","CHAPTER II—DEPARTMENT OF ENERGY","SUBCHAPTER H—ASSISTANCE REGULATIONS","PART 609—LOAN GUARANTEES FOR CLEAN ENERGY PROJECTS"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-10.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:24:09Z","sha256":"298f506fe2781e3e7734953e78ac1bdec61bff1fcc7d90403c77c89f3439a711","source_id":"us-cfr","stale":true,"prev":"us/10-cfr-609.2","next":"us/10-cfr-609.4"},"notice":"GroundRules: Original legal text.
