{"data":{"id":"us/17-cfr-38.708","jurisdiction":"us","citation":"17 CFR 38.708","heading":"Decisions.","body":"Promptly following a hearing conducted in accordance with § 38.707 of this part, the disciplinary panel must render a written decision based upon the weight of the evidence contained in the record of the proceeding and must provide a copy to the respondent. The decision must include:\n(a) The notice of charges or a summary of the charges;\n(b) The answer, if any, or a summary of the answer;\n(c) A summary of the evidence produced at the hearing or, where appropriate, incorporation by reference of the investigation report;\n(d) A statement of findings and conclusions with respect to each charge, and a complete explanation of the evidentiary and other basis for such findings and conclusions with respect to each charge;\n(e) An indication of each specific rule that the respondent was found to have violated; and\n(f) A declaration of all sanctions imposed against the respondent, including the basis for such sanctions and the effective date of such sanctions.","path":["Title 17—Commodity and Securities Exchanges","CHAPTER I—COMMODITY FUTURES TRADING COMMISSION","PART 38—DESIGNATED CONTRACT MARKETS","Subpart N—Disciplinary Procedures"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-17.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:24:31Z","sha256":"8e8ec271275b9f3c915224573ec5702ea77d0b7e4b3a9ff20d81af7fc6a96706","source_id":"us-cfr","stale":true,"prev":"us/17-cfr-38.707","next":"us/17-cfr-38.709"},"notice":"GroundRules: Original legal text.
