As used in this part:\nApplicant means any entity that applies for a Federal award directly to a Federal agency.\nEntity includes:\n(1) Whether for profit or nonprofit:\n(i) A corporation;\n(ii) An association;\n(iii) A partnership;\n(iv) A limited liability company;\n(v) A limited liability partnership;\n(vi) A sole proprietorship;\n(vii) Any other legal business entity;\n(viii) Any other grantee or contractor that is not excluded by paragraph (2);\n(ix) Any State or locality; and\n(x) any subcontractor or subgrantee that is not excluded by paragraph (2);\n(2) Does not include:\n(i) An individual recipient of Federal financial assistance; or\n(ii) A Federal employee.\nFederal Award means an award of Federal financial assistance that an entity receives from a Federal agency.\nFederal financial assistance means:\n(1) Assistance that entities receive or administer in the form of a:\n(i) Grant;\n(ii) Cooperative agreement (which does not include a cooperative research and development agreement pursuant to the Federal Technology Transfer Act of 1986, as amended (15 U.S.C. 3710a);\n(iii) Loan;\n(iv) Loan guarantee;\n(v) Subsidy;\n(vi) Insurance;\n(vii) Food commodity;\n(viii) Direct appropriation;\n(ix) Assessed or voluntary contribution; or\n(x) Any other financial assistance transaction that authorizes the entity's expenditure of Federal funds.\n(2) For the purposes of this part, the term “Federal financial assistance” does not include:\n(i) Technical assistance that provides services in lieu of money; and\n(ii) A transfer of title to federally-owned property provided in lieu of money, even if the award is called a grant.\nRecipient means an entity that receives or administers a Federal Award directly from a Federal agency.\nSystem for Award Management (SAM.gov) means the Federal repository into which an entity must provide the information required for the conduct of business as a recipient.\nUnique entity identifier means the universal identifier assigned by SAM.gov to uniquely identify an entity.","path":["Title 2—Federal Financial Assistance","Subtitle A—Office of Management and Budget Guidance for Federal Financial Assistance","CHAPTER I—OFFICE OF MANAGEMENT AND BUDGET GOVERNMENT-WIDE GUIDANCE FOR FEDERAL FINANCIAL ASSISTANCE","PART 25—UNIQUE ENTITY IDENTIFIER AND SYSTEM FOR AWARD MANAGEMENT","Subpart D—Definitions"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-2.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:23:42Z","sha256":"2d47680cc3425ce9b10cf15799cefb820c5c3472e04da501487faae845d28609","source_id":"us-cfr","stale":true,"prev":"us/2-cfr-25.300","next":"us/2-cfr-appendix-a-to-part-25"},"notice":"GroundRules: Original legal text.
