Modification of such a determination is only warranted where the party seeking the modification establishes either that there is a material change in the nature and extent of the injury-related condition, the employee has been retrained or otherwise vocationally rehabilitated, or the original determination was erroneous. However, OWCP is not precluded from adjudicating a limited period of disability following the issuance of a loss of wage-earning capacity decision, such as where an employee has a demonstrated need for surgery.","path":["Title 20—Employees' Benefits","CHAPTER I—OFFICE OF WORKERS' COMPENSATION PROGRAMS, DEPARTMENT OF LABOR","SUBCHAPTER B—FEDERAL EMPLOYEES' COMPENSATION ACT","PART 10—CLAIMS FOR COMPENSATION UNDER THE FEDERAL EMPLOYEES' COMPENSATION ACT, AS AMENDED","Subpart F—Continuing Benefits"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-20.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:24:45Z","sha256":"6ada6eb3e545de7b35ec21bc04b33fb206ccb9f6e8ade793a4dcdfb351516435","source_id":"us-cfr","stale":true,"prev":"us/20-cfr-10.510","next":"us/20-cfr-10.515"},"notice":"GroundRules: Original legal text.
