{"data":{"id":"us/25-cfr-170.461","jurisdiction":"us","citation":"25 CFR 170.461","heading":"May a Tribe approve plans, specifications, and estimates?","body":"An Indian Tribal government may approve plans, specifications and estimates and commence road and bridge construction with funds made available from the TTP through a self-determination contract, self-governance agreement, Program Agreement or other appropriate agreement, developed in accordance with 23 U.S.C. 202(b)(6) \u0026 (b)(7), if the Indian Tribal government:\n(a) Provides assurances in the contract or agreement that the construction will meet or exceed applicable health and safety standards;\n(b) Obtains advance review of the plans and specifications from a State-licensed civil engineer that has certified that the plans and specifications meet or exceed the applicable health and safety standards;\n(c) Provides a copy of the certification under paragraph (a) of this section to the Deputy Assistant Secretary for Tribal Government Affairs, Department of Transportation, or the Assistant Secretary—Indian Affairs, DOI, as appropriate; and\n(d) Provides a copy of all project documentation identified in § 170.460 to BIA or FHWA before the start of construction.","path":["Title 25—Indians","CHAPTER I—BUREAU OF INDIAN AFFAIRS, DEPARTMENT OF THE INTERIOR","SUBCHAPTER H—LAND AND WATER","PART 170—TRIBAL TRANSPORTATION PROGRAM","Subpart D—Planning, Design, and Construction of Tribal Transportation Program Facilities"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-25.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:24:59Z","sha256":"2f2bc9154dfbe0ecadc9fb840aed1dfebe1aee01483480bb56b69c34f12220a7","source_id":"us-cfr","stale":true,"prev":"us/25-cfr-170.460","next":"us/25-cfr-170.463"},"notice":"GroundRules: Original legal text.
