{"data":{"id":"us/25-cfr-84.006","jurisdiction":"us","citation":"25 CFR 84.006","heading":"Under what circumstances will the Secretary disapprove a contract or agreement that requires Secretarial approval under this part?","body":"(a) The Secretary will disapprove a contract or agreement that requires Secretarial approval under this part if the Secretary determines that such contract or agreement:\n(1) Violates federal law; or\n(2) Does not contain at least one of the following provisions that:\n(i) Provides for remedies in the event the contract or agreement is breached;\n(ii) References a tribal code, ordinance or ruling of a court of competent jurisdiction that discloses the right of the tribe to assert sovereign immunity as a defense in an action brought against the tribe; or\n(iii) Includes an express waiver of the right of the tribe to assert sovereign immunity as a defense in any action brought against the tribe, including a waiver that limits the nature of relief that may be provided or the jurisdiction of a court with respect to such an action.\n(b) The Secretary will consult with the Indian tribe as soon as practicable before disapproving a contract or agreement regarding the elements of the contract or agreement that may lead to disapproval.","path":["Title 25—Indians","CHAPTER I—BUREAU OF INDIAN AFFAIRS, DEPARTMENT OF THE INTERIOR","SUBCHAPTER F—TRIBAL GOVERNMENT","PART 84—ENCUMBRANCES OF TRIBAL LAND—CONTRACT APPROVALS"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-25.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:24:59Z","sha256":"ad7d40ce440eb82fe3d770195d0af1df5ab7042e5b70ccd2ed74870191e0c924","source_id":"us-cfr","stale":true,"prev":"us/25-cfr-84.005","next":"us/25-cfr-84.007"},"notice":"GroundRules: Original legal text.
