{"data":{"id":"us/28-cfr-79.67","jurisdiction":"us","citation":"28 CFR 79.67","heading":"Proof of chronic renal disease.","body":"(a) In determining whether a claimant developed chronic renal disease following pertinent employment as an ore transporter, the Assistant Director shall resolve all reasonable doubt in favor of the claimant. A conclusion that a claimant developed chronic renal disease must be supported by medical documentation.\n(b) A claimant or beneficiary may submit any of the following forms of medical documentation in support of a claim that the claimant contracted chronic renal disease.\n(1) Pathology report of tissue biopsy;\n(2) If laboratory or radiographic tests exist:\n(i) Abnormal plasma creatinine values;\n(ii) Abnormal glomerular filtration rate (by either measured creatinine or iothalamate clearance or calculated by MDRD equation); and\n(iii) Renal tubular dysfunction as evidenced by:\n(A) Glycosuria in the absence of diabetes mellitus;\n(B) Proteinuria less than one gram daily without other known etiology; or\n(C) Hyperphosphaturia, aminoaciduria, B-2 microglobinuria or alkaline phosphaturia or other marker of proximal tubular injury; or\n(iv) Radiographic evidence of chronic renal disease;\n(3) Autopsy report;\n(4) Physician summary report;\n(5) Hospital discharge summary report;\n(6) Hospital admitting report; or\n(7) Death certificate, provided that it is signed by a physician at the time of death.","path":["Title 28—Judicial Administration","CHAPTER I—DEPARTMENT OF JUSTICE","PART 79—CLAIMS UNDER THE RADIATION EXPOSURE COMPENSATION ACT","Subpart G—Eligibility Criteria for Claims by Ore Transporters"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-28.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:25:14Z","sha256":"ddba6c0db42c838cb0a06aafff4d97b1168d67b26e2781b06fca527e816c5e51","source_id":"us-cfr","stale":true,"prev":"us/28-cfr-79.66","next":"us/28-cfr-79.70"},"notice":"GroundRules: Original legal text.
