{"data":{"id":"us/29-cfr-4208.2","jurisdiction":"us","citation":"29 CFR 4208.2","heading":"Definitions.","body":"The following terms are defined in § 4001.2 of this chapter: employer, ERISA, IRS, Multiemployer Act, multiemployer plan, PBGC, plan, and plan year.\nIn addition, for purposes of this part:\nComplete withdrawal means a complete withdrawal as described in section 4203 of ERISA.\nEligible employer means the employer, as defined in section 4001(b) of ERISA, as it existed on the date of its initial partial or complete withdrawal, as applicable. An eligible employer shall continue to be an eligible employer notwithstanding the occurrence of any of the following events:\n(1) A restoration involving a mere change in identity, form or place of organization, however effected;\n(2) A reorganization involving a liquidation into a parent corporation;\n(3) A merger, consolidation or division solely between (or among) trades or businesses (whether or not incorporated) of the employer; or\n(4) An acquisition by or of, or a merger or combination with another trade or business.\nPartial withdrawal means a partial withdrawal as described in section 4205 of ERISA.\nPartial withdrawal year means the third year of the 3-year testing period in the case of a partial withdrawal caused by a 70-percent contribution decline, or the year of the partial cessation in the case of a partial withdrawal caused by a partial cessation of the employer's contribution obligation.","path":["Title 29—Labor","Subtitle B—Regulations Relating to Labor","CHAPTER XL—PENSION BENEFIT GUARANTY CORPORATION","SUBCHAPTER I—WITHDRAWAL LIABILITY FOR MULTIEMPLOYER PLANS","PART 4208—REDUCTION OR WAIVER OF PARTIAL WITHDRAWAL LIABILITY"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-29.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:25:20Z","sha256":"5745c35725c618803c256e281c1cdf8310fe2453feab27deeeb9101871eeea74","source_id":"us-cfr","stale":true,"prev":"us/29-cfr-4208.1","next":"us/29-cfr-4208.3"},"notice":"GroundRules: Original legal text.
