The recommendation shall be based, at a minimum, upon:\n(a) The permit application package, including the resource recovery and protection plan;\n(b) Information prepared in compliance with the National Environmental Policy Act of 1969, 42 U.S.C. 4321, et seq.;\n(c) Documentation assuring compliance with the applicable requirements of other Federal laws, regulations and executive orders other than the Act;\n(d) Comments and recommendations or concurrence of other Federal agencies, as applicable, and the public;\n(e) The findings and recommendations of the Bureau of Land Management with respect to the resource recovery and protection plan and other requirements of the lease and the Mineral Leasing Act;\n(f) The findings and recommendations of the regulatory authority with respect to the permit application and the State program; and\n(g) The findings and recommendations of OSM with respect to the additional requirements of this subchapter.","path":["Title 30—Mineral Resources","CHAPTER VII—OFFICE OF SURFACE MINING RECLAMATION AND ENFORCEMENT, DEPARTMENT OF THE INTERIOR","SUBCHAPTER D—FEDERAL LANDS PROGRAM","PART 746—REVIEW AND APPROVAL OF MINING PLANS"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-30.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:25:24Z","sha256":"a43782d90722b9a8b5d1238e8f0a59e6de216fdd94aa3221f66b99939aae837a","source_id":"us-cfr","stale":true,"prev":"us/30-cfr-746.11","next":"us/30-cfr-746.14"},"notice":"GroundRules: Original legal text.
