{"data":{"id":"us/34-cfr-222.111","jurisdiction":"us","citation":"34 CFR 222.111","heading":"What is the authority of the hearing examiner in conducting a hearing?","body":"The hearing examiner is authorized to conduct a hearing under section 8004(e) and §§ 222.109-222.113 as follows:\n(a) The hearing examiner may—\n(1) Clarify, simplify, or define the issues or consider other matters that may aid in the disposition of the complaint;\n(2) Direct the parties to exchange relevant documents or information; and\n(3) Examine witnesses.\n(b) The hearing examiner—\n(1) Regulates the course of proceedings and conduct of the parties;\n(2) Arranges for the preparation of a transcript of each hearing and provides one copy to each party;\n(3) Schedules the submission of oral and documentary evidence;\n(4) Receives, rules on, excludes, or limits evidence;\n(5) Establishes and maintains a record of the proceeding, including any transcripts referenced above;\n(6) Establishes reasonable rules governing public attendance at the proceeding; and\n(7) Is bound by all applicable statutes and regulations and may neither waive them nor rule them invalid.","path":["Title 34—Education","Subtitle B—Regulations of the Offices of the Department of Education","CHAPTER II—OFFICE OF ELEMENTARY AND SECONDARY EDUCATION, DEPARTMENT OF EDUCATION","PART 222—IMPACT AID PROGRAMS","Subpart G—Special Provisions for Local Educational Agencies That Claim Children Residing on Indian Lands"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-34.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:25:40Z","sha256":"80276d080096225d55eec7d8351c80e74da3d3dac54ad223341d0e6a0adf1fd7","source_id":"us-cfr","stale":true,"prev":"us/34-cfr-222.110","next":"us/34-cfr-222.112"},"notice":"GroundRules: Original legal text.
