{"data":{"id":"us/36-cfr-1201.13","jurisdiction":"us","citation":"36 CFR 1201.13","heading":"How will NARA contract for collection services?","body":"NARA uses the services of a private collection contractor where it determines that such use is in NARA's best interest. When NARA determines that there is a need to contract for collection services, NARA:\n(a) Retains sole authority to:\n(1) Resolve any dispute with the debtor regarding the validity of the debt;\n(2) Compromise the debt;\n(3) Suspend or terminate collection action;\n(4) Refer the debt to the DOJ for litigation; and\n(5) Take any other action under this part;\n(b) Requires the contractor to comply with the:\n(1) Privacy Act of 1974, as amended, to the extent specified in 5 U.S.C. 552a(m);\n(2) Fair Debt Collection Practices Act (15 U.S.C. 1692-1692o); and\n(3) Other applicable Federal and State laws pertaining to debt collection practices and applicable regulations of NARA in this part;\n(c) Requires the contractor to account accurately and fully for all amounts collected; and\n(d) Requires the contractor to provide to NARA, upon request, all data and reports contained in its files related to its collection actions on a debt.","path":["Title 36—Parks, Forests, and Public Property","CHAPTER XII—NATIONAL ARCHIVES AND RECORDS ADMINISTRATION","SUBCHAPTER A—GENERAL RULES","PART 1201—COLLECTION OF CLAIMS","Subpart B—General Provisions."],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-36.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:25:44Z","sha256":"d9dde44c14e5eaf467648df9f8dfdcce30772a215356a07a352bece991766018","source_id":"us-cfr","stale":true,"prev":"us/36-cfr-1201.12","next":"us/36-cfr-1201.14"},"notice":"GroundRules: Original legal text.
