{"data":{"id":"us/40-cfr-17.7","jurisdiction":"us","citation":"40 CFR 17.7","heading":"Allowable fees and other expenses.","body":"(a) The following fees and other expenses are allowable under the Act:\n(1) Reasonable expenses of expert witnesses;\n(2) The reasonable cost of any study, analysis, engineering report, test, or project which EPA finds necessary for the preparation of the party's case;\n(3) Reasonable attorney or agent fees;\n(b) The amount of fees awarded will be based upon the prevailing market rates for the kind and quality of services furnished, except that:\n(1) Compensation for an expert witness will not exceed $24.09 per hour; and\n(2) Attorney or agent fees will not be in excess of $75 per hour.\n(c) In determining the reasonableness of the fee sought, the Presiding Officer shall consider the following:\n(1) The prevailing rate for similar services in the community in which the attorney, agent, or witness ordinarily performs services;\n(2) The time actually spent in the representation of the applicant;\n(3) The difficulty or complexity of the issues raised by the application;\n(4) Any necessary and reasonable expenses incurred;\n(5) Such other factors as may bear on the value of the services performed.","path":["Title 40—Protection of Environment","CHAPTER I—ENVIRONMENTAL PROTECTION AGENCY","SUBCHAPTER A—GENERAL","PART 17—IMPLEMENTATION OF THE EQUAL ACCESS TO JUSTICE ACT IN EPA ADMINISTRATIVE PROCEEDINGS","Subpart A—General Provisions"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-40.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:04Z","sha256":"26ddde574f5295b4fb4f4dcdd13f886d1eb266c060200dc6ab757acee0c59f31","source_id":"us-cfr","stale":true,"prev":"us/40-cfr-17.6","next":"us/40-cfr-17.8"},"notice":"GroundRules: Original legal text.
