{"data":{"id":"us/40-cfr-222.9","jurisdiction":"us","citation":"40 CFR 222.9","heading":"Issuance of permits.","body":"(a) Within 30 days following receipt of the Presiding Officer's recommendations or, where no hearing has been held, following the close of the 30-day period for requesting a hearing as provided in § 222.4, the Administrator or the Regional Administrator, as the case may be, shall make a determination with respect to the issuance, denial, or imposition of conditions on, any permit applied for under this Subchapter H and shall give notice to the applicant and to all persons who registered their attendance at the hearing by providing their name and mailing address, if any, by mailing a letter stating the determination and stating the basis therefor in terms of the Criteria.\n(b) Any determination to issue or deny any permit after a hearing held pursuant to § 222.7 shall take effect no sooner than:\n(1) 10 days after notice of such determination is given if no request for an adjudicatory hearing is filed in accordance with § 222.10(a); or\n(2) 20 days after notice of such determination is given if a request for an adjudicatory hearing is filed in accordance with paragraph (a) of § 222.10 and the Administrator or the Regional Administrator, as the case may be, denies such request in accordance with paragraph (c) of § 222.10; or\n(3) The date on which a final determination has been made following an adjudicatory hearing held pursuant to § 222.11.\n(c) The Administrator or Regional Administrator, as the case may be, may extend the term of a previously issued permit pending the conclusion of the proceedings held pursuant to §§ 222.7 through 222.9.\n(d) A copy of each permit issued shall be sent to the appropriate District Office of the U.S. Coast Guard.","path":["Title 40—Protection of Environment","CHAPTER I—ENVIRONMENTAL PROTECTION AGENCY","SUBCHAPTER H—OCEAN DUMPING","PART 222—ACTION ON OCEAN DUMPING PERMIT APPLICATIONS UNDER SECTION 102 OF THE ACT"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-40.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:04Z","sha256":"8e478a43c9e8ec8e3ae56abfd4efe024d782de25e5b6ef1d1e19f0be73b8d6b4","source_id":"us-cfr","stale":true,"prev":"us/40-cfr-222.8","next":"us/40-cfr-222.10"},"notice":"GroundRules: Original legal text.
