{"data":{"id":"us/40-cfr-63.1580","jurisdiction":"us","citation":"40 CFR 63.1580","heading":"Am I subject to this subpart?","body":"(a) You are subject to this subpart if the following are all true:\n(1) You own or operate a publicly owned treatment works (POTW) that includes an affected source (§ 63.1595);\n(2) The affected source is located at a Group 2 POTW which is a major source of HAP emissions, or at any Group 1 POTW regardless of whether or not it is a major source of HAP; and\n(3) Your POTW is required to develop and implement a pretreatment program as defined by 40 CFR 403.8, or your POTW meets the general criteria for development and implementation of a pretreatment program.\n(b) If your existing POTW treatment plant is not located at a major source as of October 26, 1999, but thereafter becomes a major source for any reason other than reconstruction, then, for the purpose of this subpart, your POTW treatment plant would be considered an existing source.\nNote to paragraph (b):\nSee § 63.2 of the National Emission Standards for Hazardous Air Pollutants (NESHAP) General Provisions in subpart A of this part for the definitions of major source and area source.\n(c) If you commence construction or reconstruction of your POTW treatment plant after December 1, 1998, then the requirements for a new POTW apply.","path":["Title 40—Protection of Environment","CHAPTER I—ENVIRONMENTAL PROTECTION AGENCY","SUBCHAPTER C—AIR PROGRAMS","PART 63—NATIONAL EMISSION STANDARDS FOR HAZARDOUS AIR POLLUTANTS FOR SOURCE CATEGORIES","Subpart VVV—National Emission Standards for Hazardous Air Pollutants: Publicly Owned Treatment Works"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-40.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:04Z","sha256":"3e88486c51e424867c713a8de19bffc919070f38ff499108a99c35e74bc44464","source_id":"us-cfr","stale":true,"prev":"us/40-cfr-appendix-a-to-subpart-uuu-of-part-63","next":"us/40-cfr-63.1581"},"notice":"GroundRules: Original legal text.
