{"data":{"id":"us/42-cfr-460.6","jurisdiction":"us","citation":"42 CFR 460.6","heading":"Definitions.","body":"As used in this part, unless the context indicates otherwise, the following definitions apply:\nContract year means the term of a PACE program agreement, which is a calendar year, except that a PACE organization's initial contract year may be from 19 to 30 months, as determined by CMS, but in any event will end on December 31.\nMedicare beneficiary means an individual who is entitled to Medicare Part A benefits or enrolled under Medicare Part B, or both.\nMedicaid participant means an individual determined eligible for Medicaid who is enrolled in a PACE program.\nMedicare participant means a Medicare beneficiary who is enrolled in a PACE program.\nPACE stands for programs of all-inclusive care for the elderly.\nPACE center is a facility which includes a primary care clinic, and areas for therapeutic recreation, restorative therapies, socialization, personal care, and dining, and which serves as the focal point for coordination and provision of most PACE services.\nPACE organization means an entity that has in effect a PACE program agreement to operate a PACE program under this part.\nPACE program means a program of all-inclusive care for the elderly that is operated by an approved PACE organization and that provides comprehensive healthcare services to PACE enrollees in accordance with a PACE program agreement.\nPACE program agreement means an agreement between a PACE organization, CMS, and the State administering agency for the operation of a PACE program.\nParticipant means an individual who is enrolled in a PACE program.\nService, as used in this part, means all services that could be required under § 460.92, including items and drugs.\nState administering agency means the State agency responsible for administering the PACE program agreement.\nTrial period means the first 3 contract years in which a PACE organization operates under a PACE program agreement, including any contract year during which the entity operated under a PACE demonstration waiver program.","path":["Title 42—Public Health","CHAPTER IV—CENTERS FOR MEDICARE \u0026 MEDICAID SERVICES, DEPARTMENT OF HEALTH AND HUMAN SERVICES","SUBCHAPTER E—PROGRAMS OF ALL-INCLUSIVE CARE FOR THE ELDERLY (PACE)","PART 460—PROGRAMS OF ALL-INCLUSIVE CARE FOR THE ELDERLY (PACE)","Subpart A—Basis, Scope, and Definitions"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-42.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:11Z","sha256":"fc5990a3813014494d719b5dd63c3d2a975783ae2a91ff1ed43863c911c9537b","source_id":"us-cfr","stale":true,"prev":"us/42-cfr-460.4","next":"us/42-cfr-460.10"},"notice":"GroundRules: Original legal text.
