{"data":{"id":"us/43-cfr-35.5","jurisdiction":"us","citation":"43 CFR 35.5","heading":"Review by reviewing official.","body":"(a) If, based on the report of the investigating official under § 35.4(b), the reviewing official determines that there is adequate evidence to believe that a person is liable under § 35.3, the reviewing official shall transmit to the Attorney General a written notice of the reviewing official's intention to issue a complaint under § 35.7 of this part.\n(b) Such notice shall include—\n(1) A statement of the reviewing official's reasons for issuing a complaint;\n(2) A statement specifying the evidence that supports the allegations of liability;\n(3) A description of the claims or statements upon which the allegations of liability are based;\n(4) An estimate of the amount of money, or the value of property, services, or other benefits, requested or demanded in violation of § 35.3 of this part;\n(5) A statement of any exculpatory or mitigating circumstances that may relate to the claims or statements known by the reviewing official or the investigating official; and\n(6) A statement that there is a reasonable prospect of collecting an appropriate amount of penalties and assessments.","path":["Title 43—Public Lands: Interior","Subtitle A—Office of the Secretary of the Interior","PART 35—ADMINISTRATIVE REMEDIES FOR FRAUDULENT CLAIMS AND STATEMENTS"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-43.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:15Z","sha256":"41ef2e6a7df31a4839e06b6fb5f9282437695fa03dd2ae91dc0b4e6cacd19b80","source_id":"us-cfr","stale":true,"prev":"us/43-cfr-35.4","next":"us/43-cfr-35.6"},"notice":"GroundRules: Original legal text.
