{"data":{"id":"us/43-cfr-49.120","jurisdiction":"us","citation":"43 CFR 49.120","heading":"How will a bureau make a decision about a permit application?","body":"(a) The Federal land manager will evaluate the permit application and analyze impacts in accordance with applicable laws, regulations, and policies.\n(b) The Federal land manager may issue a permit upon determining that:\n(1) The applicant possesses the qualifications required by § 49.110;\n(2) The permitted activity and any collection that would be made under the proposed permit would further paleontological knowledge, public education, or management of paleontological resources;\n(3) The permitted activity would be consistent with the purpose and management objectives defined for the Federal land;\n(4) The permitted activity would be conducted in a manner that would avoid or minimize adverse effects to significant natural or cultural resources; and\n(5) An approved repository has confirmed in writing that it is willing to accept the collection in accordance with the terms and conditions in the permit.","path":["Title 43—Public Lands: Interior","Subtitle A—Office of the Secretary of the Interior","PART 49—PALEONTOLOGICAL RESOURCES PRESERVATION","Subpart B—Paleontological Resources Permitting; Requirements, Modifications, and Appeals"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-43.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:15Z","sha256":"d42df94cab4fee64b0d29d7bf882929f7af07b60d29ca7db54c1d42d05cc4b1c","source_id":"us-cfr","stale":true,"prev":"us/43-cfr-49.115","next":"us/43-cfr-49.125"},"notice":"GroundRules: Original legal text.
