{"data":{"id":"us/45-cfr-1150.13","jurisdiction":"us","citation":"45 CFR 1150.13","heading":"How will the Endowment contract for collection services?","body":"The Endowment will use the services of a private collection contractor where it determines that such use is in the best interest of the Endowment. When the Endowment determines that there is a need to contract for collection services, it will:\n(a) Retain sole authority to:\n(1) Resolve any dispute with the debtor regarding the validity of the debt;\n(2) Compromise the debt;\n(3) Suspend or terminate collection action;\n(4) Refer the debt to the DOJ for litigation; and\n(5) Take any other action under this part which does not result in full collection of the debt;\n(b) Require the contractor to comply with the Privacy Act of 1974, as amended, to the extent specified in 5 U.S.C. 552a(m); with the Fair Debt Collection Practices Act (15 U.S.C. 1692-1692o) and other applicable Federal and State laws pertaining to debt collection practices; and with the applicable regulations of the Endowment in this chapter;\n(c) Require the contractor to account accurately and fully for all amounts collected; and\n(d) Require the contractor to provide to the Endowment, upon request, all data and reports contained in its files related to its collection actions on a debt.","path":["Title 45—Public Welfare","Subtitle B—Regulations Relating to Public Welfare","CHAPTER XI—NATIONAL FOUNDATION ON THE ARTS AND THE HUMANITIES","SUBCHAPTER B—NATIONAL ENDOWMENT FOR THE ARTS","PART 1150—COLLECTION OF CLAIMS","Subpart A—General Provisions"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-45.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:21Z","sha256":"48e93d3abee2e996847a58675989f9a9e4fdf5e6aed7710d76052f78178926d6","source_id":"us-cfr","stale":true,"prev":"us/45-cfr-1150.12","next":"us/45-cfr-1150.14"},"notice":"GroundRules: Original legal text.
