Until the Board disposes of an appeal, the respondent shall take no action to implement the final decision appealed.\n(b) Exceptions. The respondent may—\n(1) Suspend funding (see 2 CFR 200.339);\n(2) Defer or disallow other claims questioned for reasons also disputed in the pending appeal;\n(3) In programs listed in appendix A, B.(a)(1), to this part implement a decision to disallow Federal financial participation claimed in expenditures reported on a statement of expenditures, by recovering, withholding or offsetting payments, if the decision is issued before the reported expenditures are included in the calculation of a subsequent grant;\n(4) Take other action to recover, withhold, or offset funds if specifically authorized by statute or regulation; or\n(5) Take action to require a State to suspend procedural disenrollments, as defined at 42 CFR 430.5, or continue the accrual of the civil money penalties a State owes under 42 CFR 430.49(c).","path":["Title 45—Public Welfare","SUBTITLE A—Department of Health and Human Services","SUBCHAPTER A—GENERAL ADMINISTRATION","PART 16—PROCEDURES OF THE DEPARTMENTAL GRANT APPEALS BOARD"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-45.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:21Z","sha256":"570e105b23947b55259e35677b53f042e20a7af43939e6b1247d4b885f9ee76a","source_id":"us-cfr","stale":true,"prev":"us/45-cfr-16.21","next":"us/45-cfr-16.23"},"notice":"GroundRules: Original legal text.
