{"data":{"id":"us/47-cfr-76.913","jurisdiction":"us","citation":"47 CFR 76.913","heading":"Assumption of jurisdiction by the Commission.","body":"(a) Upon denial or revocation of the franchising authority's certification, the Commission will regulate rates for cable services and associated equipment of a cable system not subject to effective competition, as defined in § 76.905, in a franchise area. Such regulation by the Commission will continue until the franchising authority has obtained certification or recertification.\n(b) A franchising authority unable to meet certification standards may petition the Commission to regulate the rates for basic cable service and associated equipment of its franchisee when:\n(1) The franchising authority lacks the resources to administer rate regulation.\n(2) The franchising authority lacks the legal authority to regulate basic service rates; Provided, however, That the authority must submit with its request a statement detailing the nature of the legal infirmity.\n(c) The Commission will regulate basic service rates pursuant to this Section until the franchising authority qualifies to exercise jurisdiction pursuant to § 76.916.","path":["Title 47—Telecommunication","CHAPTER I—FEDERAL COMMUNICATIONS COMMISSION","SUBCHAPTER C—BROADCAST RADIO SERVICES","PART 76—MULTICHANNEL VIDEO AND CABLE TELEVISION SERVICE","Subpart N—Cable Rate Regulation"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-47.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:28Z","sha256":"553fe3950f4615c6f2e992c8065ac7166a24878b18330e6621471657cc6b14de","source_id":"us-cfr","stale":true,"prev":"us/47-cfr-76.912","next":"us/47-cfr-76.914"},"notice":"GroundRules: Original legal text.
