{"data":{"id":"us/49-cfr-130.115","jurisdiction":"us","citation":"49 CFR 130.115","heading":"Consistency with Area Contingency Plans.","body":"(a) A railroad must certify for each response zone that it reviewed each applicable ACP (or Regional Contingency Plan (RCP) for areas lacking an ACP).\n(b) At a minimum, for consistency with the applicable ACP (or Regional Contingency Plan (RCP) for areas lacking an ACP), the comprehensive response plan must do all of the following:\n(1) Address the removal of a worst-case discharge, and the mitigation or prevention of the substantial threat of a worst-case discharge, of oil;\n(2) Identify environmentally sensitive or significant areas along the route, as defined in § 130.5, which could be adversely affected by a worst-case discharge, by reviewing and summarizing the applicable ACP or RCP;\n(3) Incorporate appropriate strategies identified in applicable ACPs or RCPs, to protect environmentally sensitive or significant areas identified in paragraph (b)(2) of this section;\n(4) Describe the responsibilities of the railroad and of Federal, State, and local agencies in removing a discharge and in mitigating or preventing a substantial threat of a discharge; and\n(5) Identify the procedures to obtain any required Federal and State authorization for using alternative response strategies such as in-situ burning and/or chemical agents, as provided for in the applicable ACP and subpart J of 40 CFR part 300.","path":["Title 49—Transportation","Subtitle B—Other Regulations Relating to Transportation","CHAPTER I—PIPELINE AND HAZARDOUS MATERIALS SAFETY ADMINISTRATION, DEPARTMENT OF TRANSPORTATION","SUBCHAPTER B—OIL TRANSPORTATION","PART 130—OIL SPILL PREVENTION AND RESPONSE PLANS","Subpart C—Comprehensive Oil Spill Response Plans"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-49.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:34Z","sha256":"18f0e2c7a50bf1d891461ffcc50370c59fbe9667e8cfa356a449f67a6bd88e6c","source_id":"us-cfr","stale":true,"prev":"us/49-cfr-130.110","next":"us/49-cfr-130.120"},"notice":"GroundRules: Original legal text.
