{"data":{"id":"us/49-cfr-130.31","jurisdiction":"us","citation":"49 CFR 130.31","heading":"Basic spill response plans.","body":"(a) No person may transport liquid petroleum oil in a packaging having a capacity of 3,500 gallons or more unless that person has a current basic written plan that:\n(1) Sets forth the manner of response to discharges that may occur during transportation;\n(2) Takes into account the maximum potential discharge of the contents from the packaging;\n(3) Identifies private personnel and equipment available to respond to a discharge;\n(4) Identifies the appropriate persons and agencies (including their telephone numbers) to be contacted in regard to such a discharge and its handling, including the National Response Center; and\n(5) For each motor carrier, is retained on file at that person's principal place of business and at each location where dispatching of motor vehicles occurs; and for each railroad, is retained on file at that person's principal place of business and at the dispatcher's office.\n(b) A railroad with a comprehensive plan in conformance with the requirements of subpart C of this part is not required to have a basic spill response plan for routes covered by the comprehensive plan.","path":["Title 49—Transportation","Subtitle B—Other Regulations Relating to Transportation","CHAPTER I—PIPELINE AND HAZARDOUS MATERIALS SAFETY ADMINISTRATION, DEPARTMENT OF TRANSPORTATION","SUBCHAPTER B—OIL TRANSPORTATION","PART 130—OIL SPILL PREVENTION AND RESPONSE PLANS","Subpart B—Basic Spill Response Plans"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-49.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:34Z","sha256":"54e7289423dc9a5c26b704a470e802c94796f84dadb7cc4e311c4830aa8b20d6","source_id":"us-cfr","stale":true,"prev":"us/49-cfr-130.22-130.29","next":"us/49-cfr-130.33"},"notice":"GroundRules: Original legal text.
