{"data":{"id":"us/49-cfr-245.109","jurisdiction":"us","citation":"49 CFR 245.109","heading":"Determinations required for certification and recertification.","body":"(a) After FRA has approved a railroad's dispatcher certification program, the railroad, prior to initially certifying or recertifying any person as a dispatcher, shall, in accordance with its FRA-approved program, determine in writing that:\n(1) The individual meets the prior safety conduct eligibility requirements of §§ 245.111 and 245.113;\n(2) The individual meets the eligibility requirements of §§ 245.115 and 245.303;\n(3) The individual meets the visual and hearing acuity standards of §§ 245.117 and 245.118;\n(4) The individual has the necessary knowledge, as demonstrated by successfully completing a test that meets the requirements of § 245.121; and\n(5) If applicable, the individual has completed a training program that meets the requirements of § 245.119.\n(b) Nothing in this section, § 245.111, or § 245.113 shall be construed to prevent persons subject to this part from entering into an agreement that results in a railroad obtaining the information needed for compliance with this subpart in a different manner than that prescribed in § 245.111 or § 245.113.","path":["Title 49—Transportation","Subtitle B—Other Regulations Relating to Transportation","CHAPTER II—FEDERAL RAILROAD ADMINISTRATION, DEPARTMENT OF TRANSPORTATION","PART 245—QUALIFICATION AND CERTIFICATION OF DISPATCHERS","Subpart B—Program and Eligibility Requirements"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-49.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:34Z","sha256":"a314562a2199dd6cbffe8fc260beb65996d01a1cd87b8c2fe0687a6f582f477d","source_id":"us-cfr","stale":true,"prev":"us/49-cfr-245.107","next":"us/49-cfr-245.111"},"notice":"GroundRules: Original legal text.
