{"data":{"id":"us/49-cfr-246.109","jurisdiction":"us","citation":"49 CFR 246.109","heading":"Determinations required for certification and recertification.","body":"(a) After FRA has approved a railroad's signal employee certification program, the railroad, prior to initially certifying or recertifying any person as a signal employee, shall, in accordance with its FRA-approved program, determine in writing that:\n(1) The individual meets the prior safety conduct eligibility requirements of §§ 246.111 and 246.113;\n(2) The individual meets the eligibility requirements of §§ 246.115 and 246.303;\n(3) The individual meets the visual and hearing acuity standards of §§ 246.117 and 246.118;\n(4) If applicable, the individual has completed a training program that meets the requirements of § 246.119;\n(5) The individual meets the qualification requirements of § 246.120; and\n(6) The individual has the necessary knowledge, as demonstrated by successfully completing testing and practical demonstration that meet the requirements of § 246.121.\n(b) Nothing in this section, § 246.111, or § 246.113 shall be construed to prevent persons subject to this part from entering into an agreement that results in a railroad obtaining the information needed for compliance with this subpart in a different manner than that prescribed in § 246.111 or § 246.113.","path":["Title 49—Transportation","Subtitle B—Other Regulations Relating to Transportation","CHAPTER II—FEDERAL RAILROAD ADMINISTRATION, DEPARTMENT OF TRANSPORTATION","PART 246—CERTIFICATION OF SIGNAL EMPLOYEES","Subpart B—Program and Eligibility Requirements"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-49.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:34Z","sha256":"a474258e67685bf5fddf14ab9f31b77d7f72cde337601bdeb8b0424f36816203","source_id":"us-cfr","stale":true,"prev":"us/49-cfr-246.107","next":"us/49-cfr-246.111"},"notice":"GroundRules: Original legal text.
