{"data":{"id":"us/49-cfr-271.3","jurisdiction":"us","citation":"49 CFR 271.3","heading":"Application.","body":"(a) Except as provided in paragraph (b) of this section, this part applies to—\n(1) Class I railroads;\n(2) Railroads determined to have inadequate safety performance pursuant to § 271.13; and\n(3) Railroads that voluntarily comply with the requirements of this part pursuant to § 271.15.\n(b) This part does not apply to:\n(1) Rapid transit operations in an urban area that are not connected to the general railroad system of transportation;\n(2) Tourist, scenic, historic, or excursion operations, whether on or off the general railroad system of transportation;\n(3) Operation of private cars, including business/office cars and circus trains;\n(4) Railroads that operate only on track inside an installation that is not part of the general railroad system of transportation (i.e., plant railroads, as defined in § 271.5); and\n(5) Commuter or intercity passenger railroads that are subject to Federal system safety program requirements contained in part 270 of this chapter.\n(c) If a railroad contracts out significant portions of its operations, the contractor and the contractor's employees performing the railroad's operations shall be considered directly affected employees for purposes of this part.","path":["Title 49—Transportation","Subtitle B—Other Regulations Relating to Transportation","CHAPTER II—FEDERAL RAILROAD ADMINISTRATION, DEPARTMENT OF TRANSPORTATION","PART 271—RISK REDUCTION PROGRAM","Subpart A—General"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-49.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:34Z","sha256":"88fa1e7869242fff89644dd0b2d1cbee00680a14a29c682c0a499c2d7e3047c4","source_id":"us-cfr","stale":true,"prev":"us/49-cfr-271.1","next":"us/49-cfr-271.5"},"notice":"GroundRules: Original legal text.
