{"data":{"id":"us/49-cfr-604.34","jurisdiction":"us","citation":"49 CFR 604.34","heading":"Chief Counsel decisions and appointment of a PO.","body":"(a) After receiving a complaint consistent with § 604.27, and conducting an investigation, the Chief Counsel may:\n(1) Issue a decision based on the pleadings filed to date;\n(2) Appoint a PO to review the matter; or\n(3) Dismiss the complaint pursuant to § 604.28.\n(b) If the Chief Counsel appoints a PO to review the matter, the Chief Counsel shall send out a hearing order that sets forth the following:\n(1) The allegations in the complaint, or notice of investigation, and the chronology and results of the investigation preliminary to the hearing conducted in accordance with subpart I of this part;\n(2) The relevant statutory, judicial, regulatory, and other authorities;\n(3) The issues to be decided;\n(4) Such rules of procedure as may be necessary to supplement the provisions of this part;\n(5) The name and address of the PO, and the assignment of authority to the PO to conduct the hearing in accordance with the procedures set forth in this part; and\n(6) The date by which the PO is directed to issue a recommended decision.","path":["Title 49—Transportation","Subtitle B—Other Regulations Relating to Transportation","CHAPTER VI—FEDERAL TRANSIT ADMINISTRATION, DEPARTMENT OF TRANSPORTATION","PART 604—CHARTER SERVICE","Subpart H—Decisions by FTA and Appointment of a Presiding Official (PO)"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-49.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:26:34Z","sha256":"8bdbae760711e037f227561c057334c9d6e768c64d305ceb2b509f420686f303","source_id":"us-cfr","stale":true,"prev":"us/49-cfr-604.33","next":"us/49-cfr-604.35"},"notice":"GroundRules: Original legal text.
