{"data":{"id":"us/5-cfr-339.306","jurisdiction":"us","citation":"5 CFR 339.306","heading":"Processing medical eligibility determinations.","body":"(a) In accordance with the provisions of this part, agencies are authorized to medically disqualify a nonpreference eligible. A nonpreference eligible so disqualified has a right to a higher level review of the determination within the agency.\n(b) OPM must approve the sufficiency of the agency's reasons to:\n(1) Medically disqualify or pass over a preference eligible in order to select a nonpreference eligible for:\n(i) A competitive service position under part 332 of this chapter; or\n(ii) An excepted service position in the executive branch subject to title 5, U.S. Code;\n(2) Medically disqualify or pass over a 30 percent or more compensably disabled veteran for a position in the U.S. Postal Service in favor of a nonpreference eligible;\n(3) Medically disqualify a 30 percent or more compensably disabled veteran for assignment to another position in a reduction in force under § 351.702(d) of this chapter; or\n(4) Medically disqualify a 30 percent or more disabled veteran for noncompetitive appointment, for example, under § 316.302(b)(4) of this chapter.","path":["Title 5—Administrative Personnel","CHAPTER I—OFFICE OF PERSONNEL MANAGEMENT","SUBCHAPTER B—CIVIL SERVICE REGULATIONS","PART 339—MEDICAL QUALIFICATION DETERMINATIONS","Subpart C—Medical Examinations"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-5.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:23:53Z","sha256":"40c1b9575579d806d1d39a420da2178d8e5b1009051512b2cf3e16bd6afa315c","source_id":"us-cfr","stale":true,"prev":"us/5-cfr-339.305","next":"us/5-cfr-340.101"},"notice":"GroundRules: Original legal text.
