{"data":{"id":"us/5-cfr-430.312","jurisdiction":"us","citation":"5 CFR 430.312","heading":"Using performance results.","body":"(a) Agencies must use performance appraisals as a basis for adjusting pay, granting awards, retaining senior executives, and making other personnel decisions. Performance appraisals also will be a factor in assessing a senior executive's continuing development needs.\n(b) Agencies are required to provide appropriate incentives and recognition (including pay adjustments and performance awards under part 534, subpart D) for excellence in performance.\n(c) A career executive may be removed from the SES for performance reasons, subject to the provisions of part 359, subpart E, as follows:\n(1) An executive who receives an unsatisfactory annual summary rating must be reassigned or transferred within the SES, or removed from the SES;\n(2) An executive who receives two unsatisfactory annual summary ratings in any 5-year period must be removed from the SES; and\n(3) An executive who receives less than a fully successful annual summary rating twice in any 3-year period must be removed from the SES.","path":["Title 5—Administrative Personnel","CHAPTER I—OFFICE OF PERSONNEL MANAGEMENT","SUBCHAPTER B—CIVIL SERVICE REGULATIONS","PART 430—PERFORMANCE MANAGEMENT","Subpart C—Managing Senior Executive Performance"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-5.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:23:53Z","sha256":"dcc64f99be47c35080daa236c85d3dec3c0abe936641c3e0d2f15aaaa4682f72","source_id":"us-cfr","stale":true,"prev":"us/5-cfr-430.311","next":"us/5-cfr-430.313"},"notice":"GroundRules: Original legal text.
