{"data":{"id":"us/7-cfr-3.22","jurisdiction":"us","citation":"7 CFR 3.22","heading":"CCC withholding of payment.","body":"(a) CCC may temporarily withhold issuance of payment of some or all amounts to a debtor under one or more contracts or programs. Withholding of a payment prior to the completion of an applicable offset procedure may be made from amounts payable to a debtor by CCC to ensure that the interests of CCC and the United States will be protected as provided in this section.\n(b) A payment may be withheld to protect the interests of CCC or the United States if CCC determines that:\n(1) There has been a serious breach of contract or violation of program requirements and the withholding action is considered necessary to protect the financial interests of CCC;\n(2) There is substantial evidence of violations of criminal or civil fraud laws and criminal prosecution or civil fraud action is of primary importance to program operations of CCC;\n(3) Prior experience with the debtor indicates that collection will be difficult if amounts payable to the debtor are not withheld;\n(4) There is doubt that the debtor will be financially able to pay a judgment on the claim of CCC;\n(5) The facts available to CCC are insufficient to determine the amount to be offset or the proper payee;\n(6) A judgement on a claim of CCC has been obtained; or\n(7) Such action has been requested by Justice.","path":["Title 7—Agriculture","Subtitle A—Office of the Secretary of Agriculture","PART 3—DEBT MANAGEMENT","Subpart B—Standards for the Administrative Collection and Compromise of Claims"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-7.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:24:01Z","sha256":"5d0a5fc53ac3c6d7a8af4f816a6ae10cbcfdef843691ce1143002570a9948867","source_id":"us-cfr","stale":true,"prev":"us/7-cfr-3.21","next":"us/7-cfr-3.23"},"notice":"GroundRules: Original legal text.
