{"data":{"id":"us/9-cfr-12.10","jurisdiction":"us","citation":"9 CFR 12.10","heading":"Stipulations.","body":"(a) At any time prior to the issuance of a complaint seeking a civil penalty under the Act, the Administrator, in his discretion, may enter into a stipulation with any person in which:\n(1) The Administration gives notice of an apparent violation of the Act or the regulations issued thereunder by such person and affords such person an opportunity for a hearing regarding the matter as provided by the Act;\n(2) Such person expressly waives hearing and agrees to a specified order including an agreement to pay a specified civil penalty within a designated time; and\n(3) The Administrator agrees to accept the specified order including a civil penalty in settlement of the particular matter involved if it is paid within the designated time.\n(b) If the specified penalty is not paid within the time designated in such a stipulation, the amount of the stipulated penalty shall not be relevant in any respect to the penalty which may be assessed after issuance of a complaint.","path":["Title 9—Animals and Animal Products","CHAPTER I—ANIMAL AND PLANT HEALTH INSPECTION SERVICE, DEPARTMENT OF AGRICULTURE","SUBCHAPTER A—ANIMAL WELFARE","PART 12—RULES OF PRACTICE GOVERNING PROCEEDINGS UNDER THE HORSE PROTECTION ACT","Subpart B—Supplemental Rules of Practice"],"source_url":"https://www.ecfr.gov/api/versioner/v1/full/2026-08-25/title-9.xml","current_through":"2026-08-25","vintage":"","retrieved_at":"2026-08-27T02:24:03Z","sha256":"8f35e8e47e3de4f03c640e968f61dbb2fde4e543bca3e93e0ed19d4ad8458de2","source_id":"us-cfr","stale":true,"prev":"us/9-cfr-12.1","next":"us/9-cfr-49.1"},"notice":"GroundRules: Original legal text.
