(a) The fee for filing the statement under AS 21.34.180(e) is an amount equal to one percent on gross premium charged less any return premiums as reported on the statement. The surplus lines broker shall pay the fee at the time of filing the statement and in a form and manner required by the director.

(b) If the surplus lines broker does not pay the filing fee when due, the surplus lines broker shall pay an additional late payment fee of $50 a month plus two percent of the fee due per month, or part of a month, during which the surplus lines broker fails to pay the full amount of the filing fee. The late payment fee may not exceed $250 plus 10 percent of the filing fee due. If the surplus lines broker does not pay the filing fee in the form or manner required by the director, a penalty fee will be assessed equal to 25 percent of the filing fee due, not to exceed $1,000, with a minimum penalty of $50. In addition to any other penalty provided by law, the director may assess a penalty of not more than $10,000 for a violation of this section. The director may suspend or revoke the license of a surplus lines broker that fails to pay a fee under this section.
