Ala. Code § 45-58-231.33: Suspension of Employee for Personal Misconduct Affecting Fitness or Ability to Perform Duties.

An appointing authority shall have authority to suspend an employee for any personal misconduct affecting or concerning his or her fitness or ability to perform his or her duties in the public interest. In the event an employee is suspended for more than one day, he or she shall be entitled to a public hearing by the board upon written demand thereon filed within 10 days from the date of the order of suspension. A hearing shall be held no later than 30 days following receipt of the written request therefor. If, after the hearing, the board determines that the action of the appointing authority was not with cause, the suspension shall be revoked, and the employee shall be reinstated with back pay for the time period of discharge and hearing. If after the hearing, the board determines that the action of the appointing authority was with cause, the aggrieved employee shall have the right to rehearing and appeal as hereinafter provided.
