Ala. Code § 45-59-82.48: Use of Funds; St. Clair County Circuit Clerk’s Restitution Recovery Fund.

(a) The district attorney may use application fees collected by the pretrial diversion program for the operation of the pretrial diversion program and for any purpose deemed necessary by the district attorney including, but not limited to, those listed in Section 45–59–82.45.

(b) The fees, if any, allocated to the St. Clair County Circuit Clerk for each case accepted in the pretrial diversion program shall be allocated, upon receipt of the full balance established, to the St. Clair County Circuit Clerk. The fee allocated to the St. Clair County Circuit Clerk pursuant to this subsection shall be distributed to the St. Clair County Circuit Clerk’s Restitution Recovery Fund as established pursuant to Section 12–17–225.4. Funds deposited into this account shall be kept and maintained by the St. Clair County Circuit Clerk to be available for use, at the discretion of the clerk, to support the function of the office of the clerk. Monies deposited in this fund may be expended by the clerk for staffing, equipment, operations, supplies, maintenance, education, travel, and training and shall be in addition to the amount allocated to the Unified Judicial System. Funds retained by the clerk shall not reduce the amount payable to the St. Clair County Circuit Clerk under any local act or general act or reduce or affect the amounts of funding allocated by the Administrative Office of Courts to the budget of the St. Clair County Circuit Clerk. The funds shall be audited as all other state funds are audited.
